Enforcing First Nation by-laws made under Section 81 of the Indian Act has always been challenging, and is often a major hurdle to enhancing First Nations’ governance. Recently, the Public Prosecutions Service of Canada announced a limited policy, that will see it start to enforce certain Section 81 by-laws related to the COVID-19 pandemic, where First Nations enter into protocol agreements with their local police service.
