Class actions and arbitration have traditionally existed in their own worlds, however these worlds seem to be overlapping as of late which raises many interesting issues. Can these two areas co-exist peacefully? Where do they intersect? Join our experienced faculty to discuss these timely issues as well as the following:

  • Can arbitration clauses provide access to justice to small ticket mass claims?
  • Are individual arbitrations able to supplement class actions at the individual inquiry level post-common issues trials or settlements?
  • What has the IRSS experience taught us?
  • What is the American experience with class arbitrations and can that mechanism become part of the Canadian legal landscape?
  • Where is Canadian law headed in light of the fact that the Supreme Court of Canada has recently made important decisions on the intersection of class actions and arbitration?
  • Will the Supreme Court of Canada's decisions in Uber v Heller change the role of arbitration in the employment and other near-consumer cases?
