New obligations under the Divorce Act, scheduled to come into force on March 1, 2021, will require all lawyers to encourage clients to attempt to resolve matters through a family dispute resolution process, such as mediation or collaborative law, unless clearly inappropriate. This new duty, coupled with the impacts of the current public health emergency, provide a timely opportunity to bring together traditional family lawyers and collaborative professionals to exchange ideas and share best practices.
