PROGRAM DESCRIPTION
The crisis caused by the pandemic raises unprecedented challenges for competition and foreign investment law and policy in Canada and abroad. Most notably, pre-existing trends in digital enforcement have accelerated, and foreign investments in Canada and abroad are being subjected to enhanced scrutiny. The Competition Bureau also provided new guidance on competitor collaborations to ensure adequate supply of critical products and services, and consideration of failing firms in a distressed M&A context. Macroeconomic and geo-political trends will continue to reshape the enforcement approach in Canada, with important practical implications for companies doing business in Canada.

Has the Competition Bureau applied the right balance in responding to the crisis? What will be the long-lasting impact of measures adopted thus far at the global level? And as we enter the next phase of the “new normal”, are additional policy or legislative changes required or desirable?
