Marine Liability Act and Vessel Arrest
Section 139 of the Marine Liability Act created a maritime lien for Canadian necessary suppliers in respect of the provision of necessaries to foreign vessels. This program will review recent development regarding the section 139 maritime lien as well as exploring practical and procedural elements of ship arrest and an update on the law relating to an owner’s ability to limit liability.
The three main areas of discussion will include:
- Review of s. 139 of the Marine Liability Act and unresolved issues;
- Ship arrest, including required contents of an affidavit to lead warrant; practical issues relating to sistership arrest and multiple arrests;
- A review of Peracomo Inc. v. TELUS Communications Co. [2014] 1 SCR 621 and general discussion of challenges to an owner’s ability to limit liability.
